7 U.S.C. § 1471: Definitions

an established producer or husbander of livestock or a dairy producer who is a citizen of, or legal resident alien in, the United States; or a farm cooperative, private domestic corporation, partnership, or joint operation in which a majority interest is held by members, stockholders, or partners who are citizens of, or legal resident aliens in, the United States, if such cooperative, corporation, partnership, or joint operation is engaged in livestock production or husbandry, or dairy production; or any Indian tribe (as defined in section 5304(b) of title 25 ); 2 2 See References in Text note below. any Indian organization or entity chartered under the Act of June 18, 1934 ( 48 Stat. 984 , chapter 576; 25 U.S.C. 461 et seq.), 2 commonly known as the “Indian Reorganization Act”; any tribal organization (as defined in section 5304(c) of title 25 ); 2 or any economic enterprise (as defined in section 1452(e) of title 25 ); are part of a foundation herd (including producing dairy cattle) or offspring; or are purchased as part of a normal operation and not to obtain additional benefits under this subchapter. The term “State” means any State of the United States, the Commonwealth of Puerto Rico, the Virgin Islands, or Guam. best suits the livestock producer’s operation; and is consistent with acceptable feed practices. The term “area” includes any Indian reservation (as defined in section 1985(e)(1)(D)(ii) 2 of this title). This section [amending this section and section 1472 of this title and enacting provisions set out as a note under this section] and the amendments made by this section apply to losses resulting from a disaster that occurs on or after July 28, 2005 . This section and the amendments made by this section do not apply to losses resulting from a disaster that occurred before July 28, 2005 .”
