(a) The department may enter into agreements, which shall provide funding as necessary, with governmental, nonprofit, and for-profit entities for the purpose of mitigating environmental impacts caused by transportation projects, for maintaining environmental mitigation property, as defined in Section 104, or for advance mitigation purposes, as provided in Section 800.6. These agreements may provide for the advancement of funds as necessary. (b) (1) This section shall remain in effect only until December 31, 2033, and as of that date is repealed. (2) Agreements entered into pursuant to this section before December 31, 2033, shall remain in effect beyond that date.
