An enforcement agency or the board may issue a cease and desist order to any of the following: (a) A person who is operating, has operated, or proposes to operate a solid waste facility or operates a disposal site in an unauthorized manner, or who is disposing of solid waste in any of the following manners: (1) In violation of a solid waste facilities permit or in violation of this division, or any regulation adopted pursuant to this division. (2) Without a solid waste facilities permit. (3) In a manner that causes or threatens to cause a condition of hazard, pollution, or nuisance. (b) A person who has violated, is violating, or proposes to violate Section 44000.5.
