(a) If the department determines that a producer responsibility organization or producer has not achieved the targets established pursuant to Section 42050 or 42057, the department shall, through a public process, adopt regulations that do both of the following: (1) Place requirements on the PRO or producers to achieve the recycling rates established pursuant to subdivision (c) of Section 42050 or subdivision (i) of Section 42057. (2) Place requirements on producers to source reduce, by both weight and number of items, to meet the requirements of Section 42057. (b) The regulations shall apply to the PRO or producer after the date of the target or upon the end of any approved corrective action plan, as applicable.
