(a) Except as otherwise provided, this division applies to health care decisions for adults who lack capacity to make health care decisions for themselves. (b) This division does not affect any of the following: (1) The right of an individual to make health care decisions while having the capacity to do so. (2) The law governing health care in an emergency. (3) The law governing health care for unemancipated minors.
