Section 79055 does not apply, and money from the state account shall be available, upon appropriation by the Legislature, for removal or remedial actions, if any of the following conditions apply: (a) The department, after a reasonable effort, is unable to identify a potentially responsible party for the hazardous substance release site. (b) The department determines that immediate corrective action is necessary, as provided in Section 78875. (c) The director determines that removal or remedial action at a site is necessary because there may be an imminent and substantial endangerment to the public health or welfare or to the environment, as provided in Section 78870.
