(a) Upon the state board’s approval of a district’s attainment plan, and each January 1 thereafter, the district shall publish a list of regulatory measures scheduled or tentatively scheduled for consideration during the following year. The district shall not propose a regulatory measure for consideration during any year that is not contained in the district’s most recently published list of proposed regulatory measures unless earlier consideration is necessary to satisfy federal requirements, to abate a substantial endangerment to public health or welfare, or to comply with Section 39666 or 40915. (b) Subdivision (a) does not apply to any modification of existing rules that the district finds and determines is necessary to do either of the following: (1) Preserve the original intent of the rules, as stated upon their adoption. (2) Increase opportunities for alternative compliance methodology pursuant to subdivision (d) of Section 40001.
