Notwithstanding any provision of law to the contrary, the department may, to the extent funds are available, provide for advance payments for services to be performed under pending grant agreements or contracts with clinics pursuant to the Primary Care Services Act (Section 27), at the time that the notice of award is issued if all of the following conditions are met: (a) The request for application or the request for proposals contains the terms and conditions under which advance payment may be received pursuant to this section. (b) That the total amount of the advance shall not exceed 25 percent of the amount of the proposed award, including any advance payments provided under authority of any other provision of law. (c) That the terms and conditions of the request for application or the request for proposal, specifies that the grantee shall repay the full amount of the advance if the grant or the contract is not finally approved. (d) That the department has evaluated the financial stability of the clinic and found it to be reasonably financially sound. (e) That advance payments be made only to those nonprofit agencies that request an advance in writing. (f) That the application or proposal contains the terms and conditions set forth in the request for application or the request for proposal. (g) That the application or proposal is signed by an authorized person representing the clinic.
