(a) When adopting, amending, or repealing a regulation governed by this article, the commission shall conduct the following steps at separate public meetings: (1) Approve the submission of a notice of proposed action to the Office of Administrative Law. (2) Consider public comment on the proposed action. The department shall participate in this process by reviewing and responding to all public comment. (3) Make a final decision on the proposed action. (b) The meetings required by this section may be regular or special meetings. (c) The meetings required by this section shall be duly noticed to the public in accordance with subdivision (c) of Section 110 and the Administrative Procedure Act (Chapter 3.5 (commencing with Section 11340) of Part 1 of Division 3 of Title 2 of the Government Code). (d) Within 45 days after the commission makes a final decision to adopt, amend, or repeal a regulation governed by this article, the department shall publish and distribute the regulation to each county clerk, district attorney, and judge of the superior court in the state.
