(a) There is hereby established, within the California Water Resources Development Bond Fund, the California Water Resources Development Bond Account. (b) Notwithstanding Section 13340 of the Government Code, all moneys in the account are continuously appropriated, without regard to fiscal year, to the department and shall be available for the purposes provided in Section 12935. (c) Pursuant to Section 80400, payments of certain credits received by the department are required to be deposited into the account. The use of the payments shall be consistent with all of the following: (1) The payments shall be expended for a purpose that is consistent with state law. (2) Acceptance of the payments does not impose on the state any requirement to commit or expend new state funds for any program or purpose. (3) The need exists to expend the payments during the 2023–24 fiscal year. (4) The use of the payments shall be consistent with the priorities described in subdivision (a) of Section 38590.1 of the Health and Safety Code.
