Notwithstanding any other provision of this division, no notice is required to be given to any child under the age of 12 years if the court determines either of the following: (a) Notice was properly given to a parent, guardian, or other person having legal custody of the minor, with whom the minor resides. (b) The petition is brought by a parent, guardian, or other person having legal custody of the minor, with whom the minor resides.
