(a) If a final hazardous waste facilities permit decision has not been issued by the department by the applicable hazardous waste facilities permit decision deadline pursuant to Section 25200 or 25201.6, the department shall issue a report, which shall be released to the public, that includes the reasons why the final hazardous waste facilities permit decision was not made on time. The department’s report shall specifically address all of the following: (1) The current status of work completed by the department on the hazardous waste facilities permit application. (2) The actions and information needed by the department to make the final hazardous waste facilities permit decision, and the department’s proposed schedule for issuing the final hazardous waste facilities permit decision. (3) Information supporting any determination by the department that the hazardous waste facility’s failure to provide complete or timely information caused or contributed to the department’s failure to issue the final hazardous waste facilities permit decision within the applicable hazardous waste facilities permit decision deadline. (b) The department shall prepare the report required by subdivision (a) no later than 60 days after the applicable hazardous waste facilities permit decision deadline has expired. The department shall provide a copy of the report to the hazardous waste facility that is the subject of the report required pursuant to subdivision (a). (c) This section applies to a permit for an operating hazardous waste facility and does not apply to a permit for a hazardous waste facility undergoing closure or to a closure or postclosure permit.
