(a) The Legislature finds and declares both of the following: (1) The Leviathan Mine Site is a federal Superfund site regulated by the United States Environmental Protection Agency (2) The State of California owns the Leviathan Mine Site, approximately 465 acres. (b) The Department of General Services, on behalf of the State of California, may convey all or a portion of the Leviathan Mine Site to any entity, if the director determines that the conveyance is in the best interests of the State of California. (c) The Department of General Services may convey all or a portion of the property pursuant to subdivision (b) upon those terms and conditions, and subject to those reservations and exceptions that the Director determines are in the best interest of the state, including conveying the property at less than fair market value. (d) Any conveyance pursuant to subdivision (b) may include entering into leases, easements, or other rights of entry or access to the Leviathan Mine Site as may be reasonably necessary to comply with any responsibility or authority of the State Water Resources Control Board or the California Regional Water Quality Control Board, Lahontan Region with respect to the property. (e) The Department of General Services shall be reimbursed for any cost or expense incurred in the disposition of the property described in subdivision (a) from the proceeds of the disposition, to the extent there are any. The net proceeds of any moneys received from the disposition of the property shall be deposited in accordance with subdivision (g) of Section 11011. (f) The disposition of a parcel of surplus state real property, pursuant to subdivision (b), made on an “as is” basis shall be exempt from Division 13 (commencing with Section 21000) of the Public Resources Code.
