(a) The commission, in consultation with the department, shall adopt regulations for the determination of civil damages provided for in subdivision (a) of Section 8246 that give due consideration to the appropriateness of the civil damages with respect to all of the following factors: (1) The gravity of the violation. (2) The good faith of the convicted licensee. (3) The history of previous violations. (4) The damage to the fishery. (5) The cost of restoration of the fishery. (b) Civil damages imposed under subdivision (a) of Section 8246 shall be due and payable on or before a date that is 30 days after the compromise is entered into.
